Judge in Najib case under fire

The judge in ex-PM Najib Razak’s corruption cases is under fire for his links with the fallen United Malays National Organisation (Umno).

High Court judge Mohd Sofian Abdul Razak Mohd Sofian Abdul Razak is the brother, Mohd Soffi Abdul Razak, a Pahang Umno member.

Pahang is the state where Najib is a member of the Parliament, in Pekan, and the judge’s brother a Pahang state executive councillor, as well as the assemblyperson for the Pahang state constituency of Benta.

The link between the judge and Najib’s party was exposed by concerned netizens who asked the judge to recuse himself from Najib’s case.

Today, the prominent former civil servants group G25 has joined the call for the High Court judge to recuse himself.

But it appears that he is not budging, possibly waiting for a formal application by the prosecution to get him axed.

The G25 said the judge failed to disclose the fact that his brother is a Umno member.

“Given that the former prime minister was until recently the president of Umno and chairperson of BN, and is himself a Pahang MP, the judge ought to have disclosed his relationship to his brother and the latter’s position in Umno and the state government to the prosecution and the defence prior to the hearing,” said G25.

It also said judicial precedents have established that a judge must disclose any kind of connection in a case before him to all parties at the outset, and should let the parties decide whether to ask him to recuse or not, added G25.

Frustrated Singaporeans slam Khaw Boon Wan for wasting over $250 million “taxpayers’ money” on HSR despite lack of commitment from M’sia

Transport Minister Khaw Boon Wan’s confirmation that the Singapore Government has pumped a hefty $250 million into the KL-SG High Speed Rail (HSR) project, despite the lack of clear commitment from Malaysia, has angered Singaporeans.

The HSR project was signed between the Singapore Government and the former Malaysian Government, led by ex-Prime Minister Najib Razak, that was toppled by the opposition coalition in a stunning election upset during the 2018 Malaysia General Election in May. Najib was arrested over corruption charges last week and awaits trial.

Following the election, Prime Minister Dr Mahathir Mohamad suspended the project citing that it does not justify its high costs, especially given that Malaysia is in debt to the tune of RM1 trillion.

Speaking in Parliament yesterday, Khaw said that the Government has already spent $250 million on the project, from the commencement of the project to the end on May, based on preliminary estimates. Adding that the Government incurred an additional $6 million costs in June and expects to incur a similar amount this month for the project, Khaw said:

“This is actual money that has already been spent, our taxpayers’ money.

“We can recover value for some of the expenditure, even if the HSR project does not proceed. But a significant amount which has been spent will be completely wasted expenditure if the project does not proceed.”

Khaw added that at least $40 million more is expected to be pumped into the project, between August and December 2018.

Curiously, the Government is going ahead with spending exorbitant amounts of “taxpayers’ money” into the project even though it has yet to receive official confirmation from Malaysia over whether the project is going ahead or not.

Acknowledging that numerous attempts to get official confirmation from Malaysia have yet to draw a response, Khaw said that Singapore has been “left with no choice” but to go ahead with its end of the deal. He added:

“It will be most unfortunate, if Malaysia has in fact decided to terminate, but delays in notifying us, because there will be further wasted expenditure.”

While the Minister said that the Government will continue to press for official clarification and “act according to its rights,” Singaporeans have expressed anger at the fact that the Government has spent so much on the project without consulting taxpayers.

Before the project really started already spend $250 million . I wonder if the PAP do any budget planning or not ??? How come spend so much when it only involves a part of HSR ie on the Singapore pare ??? Something very fishy here .

Transport Minister Khaw Boon Wan lied on S$250 million spending

Singapore Transport Minister Khaw Boon Wan openly lied claiming that S$250 million has been spent on the construction of the High Speed Rail (HSR) terminal in Jurong.

According to media reports, the HSR is currently only at surveying and planning stage, with standards and engineering studies done so far. Including the land acquisition costs for a country club, the total costs added thus far is only $115 million, or less than half the amount made up by Transport Minister Khaw Boon Wan.

In Dec 2015, Jurong Country Club was compensated S$89.5 million for 67 hectares of land. Only 12 hectares are reserved for the HSR construction, but no work has been done on the actual site since it was handed over to the government in Feb 2017. The second golf club, Raffles Country Club, singled out for land acquisition has not reported how much compensation were given by the Singapore government, or if any compensation has been given yet. Raffles Country Club is currently still in operations. None of the country club members has been compensated yet.

In Feb 2017, several trade specialist consultancy companies led by American-firm AECOM won a S$24.6 million contract for “advanced engineering study”.

Also in February, a three-firm consortium, made up of WSP Engineering, Mott MacDonald and Ernst & Young Advisory Services, were awarded a S$34.9 million contract for developing technical and safety standards with both Singapore and Malaysia authorities. The actual amount paid for Singapore is estimated to be about half the amount at S$17.5 million, sharing the cost with Malaysia.

The total amount added up to only S$115 million, or less than half the S$250 million claimed by the Singapore Transport Minister.

In an earlier announcement, Minister Khaw Boon Wan stated that he will add “incurred costs”, of the S$250 million spent, on top of the S$168 million (RM500 million) penalty to Malaysia. The ex-Malaysian Minister disregarded the fact that Singapore’s neighbour and his former birth place is currently in a S$340 million (RM1 trillion) debt.

1MDB: Elusive Jho Low hiding in West Indies

The elusive businessman Jho Low whisked away into the West Indies, apparently living the great life, as a citizen of Saint Kitts and Nevis islands.

Malaysia does not have an extradition treaty with Saint Kitts and Nevis. It will have to depend solely on information from Interpol on the where about of Mr Low.

But to catch the thief, they say, the local police will need more than luck.

Malaysiakini reported that Jho Low now has no other choice but to hide in the West Indies. The reason is that after he left Macau, it will be difficult for him to return to China without the Malaysian authorities being alerted.

The low flying Jho is thus a very tough bird to catch. He is essential in the 1MDB case and is a big chunk of the pie that both the Malaysian police and the US Justice Department is seeking to wrap-up one part of their investigation.

The full inquiry will only be completed if they lay their hands on the other elusive 1MDB man, Nik Faisal.

Nik Faisal may also be on the Swiss Attorney General’s list of 6 people they are seeking in the wake of their own 1MDB investigations.

Jho Low has escaped the American long arm of justice so far by flying off the radar from countries where the US has extradition treaties.

Ho Kwon Ping says that PAP will not suffer same fate as UMNO, but academics think otherwise

Speaking at an OCBC Forum entitled Singapore Politics and Business in an Age of Disruption (12 Jul), Executive Chairman of Banyan Tree Ho Kwon Ping said that the Singapore government is aware of the "jibes made against us and our political system" by the Malaysians. However, this "may not be applicable in totality".

He was a referring to an earlier comment made by Malaysian PM Mahathir bin Mohamad in May to the financial times that Singaporeans – like their Northern neighbours - "must be tired of their government".

"[We are] drawing the wrong lessons if we look at Malaysia and think that the fall of the PAP is imminent for whatever reasons that are happening across the Causeway." Ho said

He added that there is "a high degree of tolerance within Asian countries for even incompetence. But there is very little intolerance for totally selfish regimes which only perpetuate their own well-being."

This marks a huge and critical difference" between both countries and Singapore did not follow the "egregiously blatant" corruption ways of the Najib administration.

Additionally, Singapore is still helmed largely by its second generation of leaders who "clearly remember and largely perpetuate” the principles of former Prime Minister Lee Kuan Yew.

The PAP could possibly lose power over the next 20 years if it cannot rejuvenate

Nonetheless, Mr. Ho also acknowledged the possibility that the PAP might lose power in the next 20 to 30 years.

He noted that political parties historically maintain their passion and integrity of their founders for about 3 generations before "hubris sets in and the rot begins". There “must be an inflow of totally fresh new blood into the political system if we are to avoid" a fall of the PAP.

M’sian Finance Minister Lim Guan Eng says HSR still on, if costs are reduced

Lim thinks the project makes some sense.

The Straits Times reported today (July 11) that Malaysia’s Finance Minister Lim Guan Eng appeared to revive flagging hopes that the High Speed Rail (HSR) project could be back on track:

“The project by itself makes some sense but not at the exorbitant cost.”

Lim said if the price was brought down, Malaysia could consider resurrecting the project, as long as Singapore agreed on certain changes.

His remarks were made in an earlier interview with ST last Monday.

Lim added that the Pakatan Harapan government had received new offers from “people” who claimed they could cut the cost of the project by half, since Prime Minister Mahathir Mohamad first floated a “trial balloon” suggesting that the project could be scrapped.

Regarding these offers, Lim said:

“We don’t know whether that’s serious… (but) that means the whole thing was way overpriced and that raises more questions.”

Still got chance

Lim himself has previously suggested that the HSR project was not quite dead in the water, saying in a June 2018 interview with Channel NewsAsia:


“As far as the HSR is concerned, it’s scrapped for now as announced by the PM but in the future, that is something that we want to discuss with the government.

In that sense, we’re talking about the possibility of deferring and discussing with our good neighbour Singapore to see how they can help us out of this debt predicament.”

Some commenters on ST’s Facebook post of the interview were less than enthused about Lim’s latest comments.

Others echoed Minister for Transport Khaw Boon Wan’s statement in Parliament, and pointed out that the ball was still in Malaysia’s court as they had not yet made an official decision whether to cancel the HSR.

According to Khaw, the Singapore government had sent Malaysia a diplomatic note for an official statement on the HSR, but had yet to receive a reply.

Across the causeway, a historic victory by former Malaysian Prime Minister Mahathir Mohamad in May that ousted Najib Razak from his premiership made international headlines.

Many have given their take on what this means for neighbouring Singapore, because of the similarities that both countries were governed by ruling parties — People’s Action Party (PAP) for Singapore and Barisan Nasional (BN) for Malaysia — for more than five decades.

But Banyan Tree executive chairman Ho Kwon Ping has a different take.

“Foolish” to echo Mahathir’s comment on S’poreans

Ho said that while there are “unnervingly close parallels between Singapore and Malaysia”, it would be a “foolish mistake” to echo Mahathir’s remark that Singaporeans “must be tired of having the same government”. Ho was speaking on “Singapore Politics and Business in an Age of Disruption” at an OCBC forum on Thursday, July 12.

According to Today, he argued that while PAP and BN are founding parties in their countries, it does not mean that the former would suffer the same fate.

He said that Singaporeans would be “drawing the wrong lessons if we look at Malaysia and think that the fall of the PAP is imminent for whatever reasons that are happening across the Causeway”.



Corruption brought BN down

Ho pointed out that there was a “huge and critical difference” between both Singapore and Malaysia in that the latter is plagued by “egregiously blatant” corruption of the previous administration.

He contended that it was the “massively enormous corruption” of Najib’s government that brought him down, rather than the following:
•Absence of full democratic institutions
•Absence of full human rights
•Putting down of dissent
•Presence of paternalistic governance


Good governance more critical than desire for full democratic institutions

According to him, PAP’s downfall may only happen if there is widespread corruption among its leaders, not due to the desire for full democratic institutions as westerners believe.

He said:

“The Asian political culture has shown, that it is not the presence of democratic institutions, but it is the presence of good governance which is most critical. There’s a high degree of tolerance within Asian countries for even incompetence. But there is very little tolerance for totally selfish regimes which only perpetuate their own well-being.”

He added that although Singapore does not tolerate corruption, things might change if the PAP allows nepotism and cronyism to creep into the government.

To “avoid the futures that we do not wish to have”, he said “there must be an inflow of totally fresh new blood into the political system”.

Things PAP should be careful of

Ho warned of the possibility that the PAP might no longer be in power in the future, although it might only happen in the next 20 to 30 years. This is because Singapore is still ruled by its second generation of leaders, who still “clearly” remember the principles of the late Prime Minister Lee Kuan Yew.

However, a lack of new solutions to solve future problems, complacency, and internal competition within the party could be detrimental to the PAP.

Najib in state of shock at ‘betrayal’ within Umno

Ex-PM Najib Razak is in a state of disbelief that he was betrayed by party members in the recently concluded General Elections in Malaysia.

Najib said to a small gathering organised by his loyal supporters that party members were behind the party’s failed bid to retain power in May.

The Umno suffered a huge defeat in the elections, but Najib won his seat in Pekan, Pahang. Most of the support he is getting these days are from his constituents.

But Najib said the main reason the party suffered its first electoral defeat was the presence of turncoats.

He said many of them held party posts but decided to go against him and the party.

He believes the turncoats – organised in factions within the Umno – put their personal interest ahead of the party.

“We only think of how we could profit. We think more for our factions, and if we don’t get what we want, we would go as far as betraying the party,” he said as quoted by Sinar.

He said those turncoats believed as if they held the party ransom.

“And what is weirder is that they are done by those with positions so it’s not surprising then if we were to be attacked by our opponents, being seen as a party that has lost the traditional values of its struggle.”

“It’s better for people like these to leave Umno. We only want those who will die for the party,” he firmly stated.

[KUALA LUMPUR] Malaysia's Economic Affairs Minister Mohamed Azmin Ali said on Wednesday he will lead a delegation to Singapore soon to have a discussion on the high-speed rail (HSR) project and also to safeguard the diplomatic relationship between both countries.

He said the Attorney General's Chambers (AGC) has examined the bilateral agreement between both nations and that there are clauses that allow either Malaysia or Singapore to opt out of the HSR project.

Datuk Seri Azmin said according to the feedback from the AGC, the matter must be resolved based on the laws, which also involves bilateral negotiations.

"We are looking at all the available options. The bilateral agreement on the HSR provides for either party to cancel the project. This however, is subjected to the terms and conditions of the agreement," he said in parliament.

"I must stress that any agreements inked must be fair and just to both parties," said Mr Azmin.

He was replying to opposition leader Ahmad Zahid Hamidi, who was elected president of Umno recently, who had asked what aspects are being examined after the Malaysian government said the Singapore-Kuala Lumpur HSR project was being reviewed.

To another question from former prime minister Najib Razak, Mr Azmin said that the RM110 billion (S$37.05 billion) is an estimated costing.

Mr Najib had asked how the government arrived at the RM110 billion price tag for the project when international tenders for the 350km-long project will only end this December.

"The open tenders will be looked at and decided by both Governments, which means that the exact cost of the project is not known as the tender is still open.

Bloomberg: Singapore’s economic lead over Malaysia is Shrinking

In an article on Tuesday (17 Jul), Bloomberg noted that the economic gap between Singapore and its Northern neighbour is set to shrink over the next year.





The author noted that after trailing for a third consecutive year, Malaysia “is inching closer to regaining its lead over Singapore’s economy”.

Malaysia’s GDP in 2017 was $314.5 billion, which is approximately $9.4 billion less than Singapore’s $323.9 billion”

However, Malaysia’s faster economic growth will mean that the gap is closing.

Based on median estimates of economists surveyed by Bloomberg, Malaysia’s economy will expand by about 5.5% in 2018 as compared to 3.1% for Singapore. In other words, the deficit will shrink to just over $2 billion next year.

Businesses in Malaysia are more confident with the Pakatan Harapan coalition government

A news report from Malaysia’s New Straits Times (21 May) said that the appointment of Billionaire Robert Kuok as part of the Council of Elders (CoE) will enhance confidence in the stock market and local government.

Malaysian Industrial Development Finance research head Redza Rahman felt that Kuok’s experience is dealing with the Chinese and Hong Kong governments would be extremely useful to ensure that Malaysia’s relationship with its biggest trading partner continued to be on cordial basis.

Agreeing, Maybank’s Head of Research Wong Chew Hann added that the CoE “comprises very experienced and well-respected names in the investment community.” Amongst others, committee members include former Finance Minister Tun Daim Zainuddin and former Central Bank governor Tan Sri Dr Zeti Akhtar Aziz.

More recently (28 Jun), China’s Xin Hua news reported that Malaysian businesses were more optimistic about the new Pakatan Harapan government. Surveying close to 3,500 SMEs and corporates, the survey said that business outlook in the near term remains upbeat with expected improvements in both turnover and profitability.

Malaysia to negotiate deferment of High-Speed Rail with Singapore: Mahathir

KUALA LUMPUR: Malaysia Prime Minister Mahathir Mohamad said his government will look to negotiate with Singapore the deferment of the High-Speed Rail (HSR) project.

Dr Mahathir said previously he would cancel the rail link between Kuala Lumpur and Singapore, and would discuss with Singapore about any compensation that has to be paid.

"When we looked at the financial situation of the country we thought that we couldn't go ahead (with the HSR),” he told reporters in parliament.

“But having studied it and the implication of unilaterally discarding the contract, we decided we may have to do it at a later date, we may have to reduce the price. But reduction of the price is very difficult as far as we can make out. So it has to be deferred."

Economic Affairs Minister Azmin Ali on Wednesday said he planned to visit Singapore by the end of July to discuss the status of the agreement entered into by the previous Najib Razak-led government.

Singapore on Jun 1 sent Malaysia a diplomatic note to seek clarification on the HSR project. There has been no reply to the note, although the Malaysian government has informed Singapore that it will propose dates for a meeting by Jul 31.

Pakatan Harapan took over after the Mahathir-led coalition won the general elections on May 9. It has been reviewing several mega projects as part of their election pledges and to trim down on debts and liabilities.

"Singapore wants to know what's our stand, but officially now we are sending the minister," said Dr Mahathir.

M’sia, Spore to discuss HSR in end July; project likely to be deferred

Earlier today (July 19, 2018), Dr Mahathir told Channel NewsAsia in a doorstop interview that the Singapore-Kuala Lumpur High Speed Rail (HSR) project is likely to be postponed to a later date:


This is what he said:


“At the moment when we look at the financial situation of the country, we thought we couldn’t go ahead with that.

But having studied it…. the implications of unilaterally discarding the contract and the cost of it… we decided that maybe we will have to do it at a later date…or we may have to reduce the price, but reduction of the price, I think, is very difficult as far as we can make out, so it will have to be deferred.”

Change in tone from previous announcements

This reply is a change from Mahathir’s previous statements to the media that the HSR is too costly for Malaysia to bear as it is currently facing upwards of RM1 trillion in debt and liabilities. Mahathir recently told Channel NewsAsia that his government wishes to bring that amount down to around around RM300 billion to RM500 billion.

Doing away with expensive infrastructural projects – even those that were already signed for – was one of the campaign promises that the Mahathir-led Pakatan Harapan (PH) coalition made in order to win in the election.

Representatives to meet in July

Mahathir’s response comes a few days after his Economic Affairs Minister Mohamed Azmin Ali told the media that the fate of the HSR is uncertain, saying that it is not a “terrible project” and “any infrastructural project will benefit both Malaysia and Singapore”.

Azmin also confirmed that a Malaysian representative will be sent to Singapore to discuss the fate of the HSR by the end of July.

Singapore’s Ministry of Transport (MOT) also confirmed on July 19 that the Malaysian government has informed them that the latter will confirm the date for the July meeting soon.

This comes on the heels of Transport Minister Khaw Boon Wan’s recent reply in Parliament that Malaysia did not send any official reply to Singapore regarding the termination of the HSR project and that Singapore will exercise its right to compensation if it is terminated.
